1. Acceptance of terms
These Terms of Service (“Terms”) govern your use of the WebHostLB website and the services we provide. By engaging WebHostLB for any service, placing an order, or using our website, you agree to these Terms. If you are entering into these Terms on behalf of a business, you confirm that you are authorized to bind that business.
2. Definitions
- “WebHostLB”, “we”, “us”, “our” — WebHostLB, a web agency based in Beirut, Lebanon.
- “Client”, “you”, “your” — the individual or business that engages our services or uses our website.
- “Services” — any service we provide, including web design, managed hosting, business email, domains, SEO, e-commerce, care and maintenance plans, site migration, and AI Enablement.
- “Deliverables” — the custom work product we create for you under an engagement.
3. Services overview
WebHostLB provides web design, managed WordPress hosting, branded business email, domain registration, SEO, e-commerce, care and maintenance plans, site migration, and AI Enablement services. The specific deliverables, scope, timeline, and price for any engagement are set out in the applicable quote, order, or project agreement, which forms part of these Terms.
4. Accounts & eligibility
To use certain Services you may need an account. You agree to provide accurate information, to keep your account credentials secure, and to be responsible for activity under your account. Our Services are intended for businesses and individuals aged 18 or older.
5. Fees, billing & renewals
Prices are quoted in US dollars (USD). Payment is accepted through Whish and OMT. Recurring Services (such as hosting, email, domains, and care plans) are billed in advance for the chosen term and renew automatically at the end of each term unless cancelled before renewal. We will provide reasonable advance notice of upcoming renewals where practicable.
Invoices are due on receipt. Overdue accounts may incur a late-payment charge, and Services may be suspended after written notice if payment remains outstanding. Domains and other third-party services that lapse for non-payment may not be recoverable.
6. Refunds & money-back
New managed hosting plans carry a 14-day money-back guarantee on the first hosting term: if you are not satisfied within 14 days of activation and our team cannot resolve your concerns, you may request a refund of that term. Domain registrations, renewals, and other third-party pass-through charges are non-refundable once purchased.
Project and professional-services fees (web design, custom development, SEO, migration, AI Enablement, and similar work) are non-refundable once work has begun. Where it is reasonable to do so, we will pro-rate fees for work not yet performed. Specific refund terms for a project are set out in its project agreement.
7. Client responsibilities & acceptable use
You are responsible for the content you publish and the lawful use of your Services. You agree not to use our Services to host or transmit illegal, infringing, malicious, or abusive content; to send unsolicited bulk email (spam); to distribute malware; or to engage in any activity that violates Lebanese law or applicable international law. Hosting resources are provided on a fair-use basis; excessive use that degrades shared infrastructure may require an upgrade or remediation.
8. Intellectual property
You retain ownership of the content and materials you provide to us. Ownership of the custom Deliverables we create specifically for you transfers to you upon full payment for the relevant engagement. We retain ownership of our pre-existing tools, frameworks, code libraries, and methodologies, and of any third-party components, which remain licensed under their respective licenses. Unless otherwise agreed, we may reference completed work in our portfolio.
9. Third-party services & domains
Some Services rely on third-party providers, including domain registrars, payment providers, and software vendors. Your use of those services may be subject to their own terms. We are not responsible for the acts, omissions, pricing changes, or availability of third parties, though we will use reasonable efforts to assist you in managing them.
10. Service levels & maintenance
We target 99.9% uptime for managed hosting. This is a target, not a guarantee, and excludes scheduled maintenance, factors outside our reasonable control, and issues caused by Client content or third parties. We aim to announce scheduled maintenance in advance where practicable. We perform routine backups as a courtesy, but backups are provided on a best-effort basis — you are responsible for keeping your own copies of important data.
11. Warranties & disclaimers
Except as expressly stated in a signed agreement, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
12. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services is limited to the amount you paid for the affected Service in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.
13. Indemnification
You agree to indemnify and hold WebHostLB harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Services, or your breach of these Terms or applicable law.
14. Suspension & termination
We may suspend or terminate Services for non-payment, breach of these Terms, or activity that threatens the security or integrity of our infrastructure or other clients. Either party may terminate ongoing Services with reasonable written notice as set out in the applicable plan or agreement. Pre-paid amounts for unused periods will be refunded on a pro-rated basis where reasonable, except for non-refundable items.
15. Data on termination
Following termination, we will make your site data and content available for a reasonable period so you can retrieve or migrate it, after which it may be deleted from our systems. We will provide reasonable assistance with migration to another provider; significant migration work may be quoted separately. You remain responsible for keeping your own backups.
16. Governing law & jurisdiction
These Terms are governed by the laws of the Lebanese Republic. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Beirut, Lebanon.
17. Changes to terms
We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, notify active customers. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
